Entenda o caso do corte nos cabos do VAR

Depois do Superior Tribunal de Justiça Desportiva (STJD) decretar que o jogo entre Avaí e Fluminense seria com os portões fechados, os catarinense entraram com pedido para que a punição seja apenas na próxima rodada em casa. Com isso, iniciou a venda de ingressos na quinta, mas logo suspendeu.

Vale destacar que a acusação (por meio de uma liminar) é em virtude de cabos do VAR que foram cortados durante o confronto com o Atlético-GO. No entanto, o julgamento seria realizado na sexta-feira, dia 14, e os catarinenses fizeram o pedido para que os portões fossem abertos.

De acordo com o STJD, nada mudou e a liminar para o jogo com portões fechados continua valendo. No entanto, o clube catarinense trabalhou com a ideia de tentar reverter e utilizou uma argumentação pautada no Regulamento Geral de Competições (RGC).

O Avaí foi pautado no artigo 64, Parágrafo 3º, do RGC, que cita que a punição a um clube brasileiro só poderá ser executada após dez dias decorridos do recebimento de comunicação da Justiça Desportiva. O julgamento seria realizado nesta sexta, mas foi adiado.

Confira a nota de repúdio do Avaí

O Avaí vem por meio desta nota, também, repudiar a decisão por meio dos seguintes argumentos:

1. A aplicação da pena se dá de forma sumária, ou seja, sem a possibilidade de defesa por parte do Avaí FC. O Clube teve seu direito constitucional vilipendiado. A decisão liminar determina o cumprimento de uma punição sem que fosse oportunizado ao Clube apresentar sua defesa, em que poderia demonstrar por meio de provas documental, testemunhal e por imagens que não é responsável pelos problemas ocorridos na partida com relação aos cabos de VAR.

2. O julgamento do processo estava pautado para a data de hoje (14.10.2022), o que evitaria que a pena fosse cumprida antes do julgamento, mas o relator surpreendentemente adiou (e posteriormente manteve este adiamento) o julgamento para que fosse ouvido o Delegado da partida do dia 01.10.2022 – Delegado este que confirmou sua presença na sessão de hoje, mediante declaração assinada e com firma reconhecida.

3. Pelo parágrafo sétimo do artigo 68 do Regulamento Geral de Competições, “O cumprimento da pena de perda de mando de campo com portões fechados dar-se-á na partida que venha a ocorrer após decorridos 10 (dez) dias do recebimento da comunicação do julgamento que a impuser, em razão dos prazos necessários para as ações operacionais relacionadas à partida” – o que não ocorreu, já que a perda de mando de campo com portões fechados foi determinada em 08/10/2022. E caso ainda assim não se entendesse, de forma que se considerasse a decisão do dia 06/10/2022 para contagem do prazo, o parágrafo terceiro do artigo 64 do mesmo RCG impõe que “A DCO somente executará a pena de perda de mando de campo na partida que venha a ocorrer após decorridos 10 (dez) dias do recebimento de comunicação da Justiça Desportiva que a impuser (…)”. Ora, se a decisão que aplicou “pena de perda de mando de campo com portões fechados” foi prolatada em 06/10/2022, e comunicada em 07/10/2022, não haveria que se falar em cumprimento da referida decisão na partida entre Avaí FC e Fluminense, designada para 16/10/2022.

4. A Diretoria de Competições da CBF é a responsável – por força do art. 175, parágrafo segundo do CBJD – por determinar a forma de cumprimento da pena e jamais poderia fazê-lo ao arrepio do seu próprio Regulamento Geral das Competições. Eximiu-se, portanto, de seu regular papel, sem qualquer respaldo jurídico que a sustentasse.

5. O documento em que informa o Cumprimento de Perda de Mando só foi encaminhado ao Clube no dia de ontem, 13/10, às 14h30, após o início da complexa operação de jogo.

Com estes lamentáveis atos, tanto CBF quanto STJD depreciam sua própria competição, impondo aos torcedores – os verdadeiros donos do futebol brasileiro – o triste cenário de um espetáculo sem público.

O Avaí entrará em contato com os torcedores do clube que adquiriram ingressos para a partida para alinhar a forma de ressarcimento. Os torcedores do visitante devem entrar em contato no e-mail [email protected] para proceder a devolução.

Pedimos desculpas aos sócios e torcedores pelos transtornos ocorridos. O Avaí, mais um vez, lamenta a decisão e reforça o entendimento de que está sendo prejudicado com tal medida, bem como avaliará a adoção das providências pertinentes para reparação pelos responsáveis das perdas e danos sofridos.

Trott suggested that his players had benefited from the experience of playing with and against England’s players in franchise leagues, realising that despite their status as world champions, they were “human” too. “They get to know the ins and outs of each player, so there’s that familiarity and also the confidence,” he said.”Sometimes, I think when you see big Test-playing nations, you hold them in high regard. Playing with players like that, you see that they are human, and you are just as entitled to win or do well [as they are]… that’s the beauty of the World Cup, isn’t it? That’s what cricket is about.”I’m just chuffed with the players. The things that we’ve spoken about as a side, we’ve agreed if we get these things right, we can compete with anybody in the world. These guys work incredibly hard. I’m really impressed with them. They will see the rewards, and this will encourage them to kick on even more.”Trott also acknowledged the bigger picture of Afghanistan’s win. Last weekend, over 1,000 people were killed and many more injured in an earthquake in the west of the country. The players wore black armbands in memory of the victims during their defeat to India on Wednesday, and several players have donated substantially to relief efforts.”It’s not just cricket that the guys are playing for,” Trott said. “The guys are very knowledgeable of the things and the hardship that some people are going through because of the natural disaster, and for various other reasons. If this can give a smile to people’s faces anywhere in the world, but also encourage boys and girls to pick up a cricket bat or a cricket ball and get playing cricket wherever they are in Afghanistan, then that’s the goal that’s been achieved.”It’s very pleasing. There’s a lot of confidence that will hopefully come from this when competing against the bigger nations and it’ll have a knock-on effect to all the other games – not only in this World Cup, but for the future as well. Sobre o revés para o Fluminense, Róger Guedes acredita que não houve apatia por parte do Corinthians, e deu méritos para a equipe de Diniz.

-Correr errado não tem haver com apatia. Demos o nosso melhor contra uma equipe chata de jogar. A gente venceu eles na Copa do Brasil, e hoje eles foram felizes aqui. A maioria dos times sofrem com eles. Se você não acerta a marcação neles, eles saem, méritos do Diniz, fez um belo papel. Tem que saber marcar a equipe deles – concluiu.

They’ve already felt the effects of losing experienced batters. Bowlers win Test matches, it’s true, but batters can lose them, in ways that aren’t immediately apparent. India came away from Hyderabad with the impression that they lost that Test match on day two, when their batters, one after another, fell while attempting boundary hits. Eight of their top nine got past 20, and three of them got into the 80s, but none of them got to three figures. The aggression that cost them their wickets also brought them their runs, yes, but you could easily imagine Virat Kohli, in the same conditions and against the same attack, going at a not-dissimilar clip while hitting nothing in the air, and piling up what may have seemed to him a double-hundred for the taking.In Visakhapatnam, India will miss not just Kohli but also KL Rahul and Ravindra Jadeja, two of their three most experienced batters from the first Test.And the loss of Jadeja, needless to say, will leave them without half of one of the greatest spin-bowling duos in history. It’s a massive blow, particularly since India are already without Mohammed Shami, whose absence in Hyderabad left them without a supreme wicket-taker in Indian conditions while also – given their seeming lack of faith in Mohammed Siraj – piling extra overs onto their spinners’ shoulders.It’s a reflection of how good India are that Jadeja’s likely replacement is Kuldeep Yadav, a bowler who’d probably be part of England’s first-choice attack in every Test match, home and away, if they could magically change his nationality. Stats and trivia Ashwin is four wickets away from becoming the second India bowler to reach the 500 mark in Test cricket. Ashwin (95) is just one wicket behind Bhagwath Chandrasekhar, India’s leading Test wicket-taker against England. Anderson (139) is a distant first on the England-India Test wicket-takers’ list. Jasprit Bumrah, meanwhile, needs four wickets to get to 150 in Tests. Rohit Sharma made centuries in both innings the last time India played a Test in Visakhapatnam. A similar Test this time will help him go past 4000 Test runs. He currently has 3800. Root (11,477) has more Test runs than India’s entire squad in Visakhapatnam (10,702). Anderson is set to play his 14th Test match in India, joining Keith Fletcher, Gordon Greenidge, Clive Lloyd and Ricky Ponting in joint third place in the overseas players’ list, with only Viv Richards (15) and Derek Underwood (16) ahead of them.
